In pursuance of paragraph 8 of the Decision of the Interstate Council of the EurAsEC (Supreme Body of the Customs Union) dated November 27, 2009 N 18 "On the unified customs and tariff regulation of the Customs Union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation", the Government of the Russian Federation DECIDES:

1. Approve the attached changes that are made to the acts of the Government of the Russian Federation.

2. Recognize as invalid the acts of the Government of the Russian Federation according to the list according to the appendix.

14. In paragraph 1 of Decree of the Government of the Russian Federation of November 3, 2003 N 665 "On the establishment of checkpoints across the state border of the Russian Federation for the arrival of poultry meat and edible offal into the customs territory of the Russian Federation" (Collected Legislation of the Russian Federation, 2003, N 45, article 4385) the words "TN VED of Russia" shall be replaced by the words "TN VED TS".

15. In the text of Decree of the Government of the Russian Federation of November 13, 2003 N 685 "On the criterion for sufficient processing of processed raw sugar and white sugar imported into the customs territory of the Russian Federation" (Collected Legislation of the Russian Federation, 2003, N 46, art. 4478) the words "Commodity Nomenclature for Foreign Economic Activity of the Russian Federation" shall be replaced by the words "Unified Commodity Nomenclature for Foreign Economic Activity of the Customs Union".

Classification of drug lot sizes

The batch size of drugs can be:

• significant - the weight of a substance that exceeds a single dose of use. The applicant claims that part six of Article 15 of the Criminal Code of the Russian Federation, in conjunction with Article 399 of the Criminal Procedure Code of the Russian Federation, limits the possibility of changing the category of crime when considering the execution of sentences that did not take into account the actual circumstances necessary for such a change, and part one of Article 10 of the Criminal Procedure Code of the Russian Federation in conjunction with the first part of Article 3 of this Code allows the court to decide on the application of the rules on the retroactive effect of the Decree of the Government of the Russian Federation of October 1, 2012 N 1002 "On approval of a significant, large and especially large amount of narcotic drugs and psychotropic substances, as well as significant, large and extra large sizes for plants containing narcotic drugs or psychotropic substances, or parts thereof containing narcotic drugs or psychotropic substances, for the purposes of Articles 228, 228.1, 229 and 229.1 of the Criminal Code of the Russian Federation," depending on the specific corpus delicti and the content of the new criminal law norm.

The Government of the Russian Federation in accordance with Federal Law 18-FZ of 01.03.2012. Decree No. 1002 of October 01, 2012 was adopted “On approval of significant, large and especially large sizes of narcotic drugs and psychotropic substances, as well as significant, large and especially large sizes for plants containing narcotic drugs or psychotropic substances, or parts thereof containing narcotic means or psychotropic substances, for the purposes of Articles 228, 2281, 229 and 2291 of the Criminal Code of the Russian Federation”.

This resolution approved the new sizes of narcotic drugs for their use in accordance with the new wording of Articles 228, 228.1, 229, 229.1 of the Criminal Code of the Russian Federation, which will come into force on 01.01.2013. With the entry into force of Decree No. 1002 (also from 01.01.2013), new sizes of narcotic drugs and psychotropic substances will be divided into three categories: significant, large and extra large.
I want to note right away: after the introduction of new sizes (or, as they say, weights), previously passed sentences will not be reviewed. New editions of the “drug addict” articles of the Criminal Code of the Russian Federation and new sizes of drugs significantly toughen the punishment for crimes. Take, for example, cannabis oil (“khimka”). Currently, a large size is set - 0.4 grams, extra large - 5 grams.

The current version of Article 228.1 of the Criminal Code of the Russian Federation provides for the following sanctions:

Under part 1 for the sale of any weight up to 0.4 grams: from 4 to 8 years in prison;
- under part 2 for selling on a large scale, that is, from 0.4 to 5 grams: from 5 to 12 years in prison;
- under part 3 for selling on an especially large scale, that is, from 5 grams to infinity: from 8 to 20 years in prison.

The version of Article 228.1 of the Criminal Code of the Russian Federation, which comes into force on 01.01.2013, will already provide for other sanctions:

Under part 1, the sanctions and the amount of narcotic substances have not changed;
- Part 2 introduces liability for selling in public places and using the Internet: from 5 to 12 years in prison;
- under part 3 for sale in a significant amount, that is, from 0.4 to 5 grams: from 8 to 15 years in prison (now liability for the same weight is established by part 2 and ranges from 5 to 12 years l / s);
- under part 4 for selling on a large scale, that is, from 5 grams to 1 kg: from 10 to 20 years in prison;
- under part 5 for selling on an especially large scale, that is, over 1 kg: from 15 to 20 years in prison.

Thus, the replacement from the beginning of 2013, for example, of a large size with a significant amount of a narcotic drug will not affect the sanction for this weight in any way, therefore there are no grounds for reviewing already passed sentences. On the other hand, the punishment for those who commit a crime related to drug trafficking, starting from 01.01.2013, will be significantly increased. Lower sanctions for all parts of Article 228.1 of the Criminal Code of the Russian Federation (except for the first) have increased by 2-3 years.
It is also worth noting that due to the tougher punishment, Law 18-FZ will not have retroactive effect. That is, all persons who have committed crimes related to drug trafficking, until 01.01.2013. they will be judged according to the current version of the Criminal Code of the Russian Federation, even if the trial will take place after the beginning of 2013.

The only relief available in Decree No. 1002 concerns aqueous solutions of narcotic drugs and psychotropic substances from List I. Since 2013, for all liquids and solutions containing at least one narcotic drug or psychotropic substance listed in List I, their quantity is determined by the mass of dry residue after drying to constant weight at a temperature of + 70 ... + 110 degrees Celsius. There was no such note in the Resolution in force until 2013, so the weight was determined by the weight of the entire mixture. On this basis, it is theoretically possible to review sentences after 01.01.2013.
