The Ministry of Justice proposed to amend the Civil Procedure, Family Codes and the law on enforcement proceedings. If they are accepted, the only residence will no longer be protected from foreclosure. Apartments, houses, land plots and shares in common property can be taken for debts, even if a family with children has nowhere else to live.

If the court decides to foreclose on the property, it will be sold. Proceeds from the sale will be used to pay off the debt, the enforcement fee and legal costs. So that debtors do not remain on the street, after the sale they will in any case receive money to buy housing at the minimum rate for all family members. That is, a family with two children will be able to buy some kind of housing, even if the apartment does not cover the amount of the debt.

If you have two adults, two children and an apartment in Moscow with an area of ​​70 sq. m, they cannot take her away for debts.

If your ex-husband lives in a small one-room apartment in Tula, he will not be able to oblige him to give this housing on account of alimony debt.

If you inherited a large, but old house, and it costs less than two norms in the region, it will also not be taken away for debts. Conditions for area and price must be met simultaneously.

And if we live with a mother-in-law, a brother and a great-aunt, are they entitled to a norm?

Family members are spouses, children and parents of the owner (Article 31 of the LC RF). Mother-in-law, brother, aunt and grandfather can also be recognized as family members, if it is in this capacity that you moved them into an apartment and registered them there. That is, they conduct a common household with you and do not pay you for eating.

The composition of the debtor's family members will be determined by the court. You can ask neighbors to confirm that relatives did not come to visit for the weekend, but have been living with you for a long time. If there is other evidence, provide it (Article 55 of the Code of Civil Procedure of the Russian Federation).

The court will take into account the proportionality of the debt and the value of the property. Bailiffs will be denied a claim if the debt, including court costs, is less than 5% of the price of the apartment. It will not be possible to put up the only housing for sale if after the sale you are entitled to more than 50% of its value.

For example, you have a large apartment in the center of Moscow, live there with your wife and have not paid 50,000 rubles for a TV in installments. The bank cannot go to court with a demand to put your property up for auction and pay off the debt.

What if I have a small house but a lot of land?

The Ministry of Justice came up with a solution for such cases. The land will be divided by court order. You will be left with the minimum area that is needed to operate the house. The rest will be up for auction.

And what should I do now?

The law has not yet been adopted. But the Ministry of Justice justified the amendments by protecting the interests of minor children and creditors. Banks cannot collect money from debtors living in luxury apartments. Parents do not provide housing for children during a divorce or refuse to support them. Bailiffs do not have mechanisms for recovery. These are weighty arguments for deputies and the public.

Arrange in advance with the bank about debt restructuring. Set up a payment schedule and stick to it. Talk to the bailiff and start paying off the debt regularly.

If you have children, but they are registered with your mother-in-law, register them in your apartment so that the housing norms are considered for all family members.

If your grandmother constantly lives with you or you are caring for a disabled relative, you should register them. Collect evidence for the court that this is a family member, not a guest. The court will consider all the circumstances and may increase the norms of living space.

If the share in your apartment formally belongs to a person who has a lot of debts, register the property for yourself. If you have a share in your parents' apartment and a lot of debt, do not put someone else's property at risk - give a share to your parents.

Get your marriage right. If you do not live with your spouse and have a common apartment, dissolve the marriage and divide the property so as not to be responsible for his debts. If you have a civil marriage and the property is joint, put a stamp in your passport so that the court takes into account all family members when calculating the rate.

If you have a spacious apartment and a lot of debt, consider moving to a more modest apartment. And give the difference in price to the bank to pay off at least part of the debt. Now you have time to sell the apartment for a good price. Then the court can evaluate it cheaper.

First of all, creditors will apply for persistent non-payers. If you don't find yourself among them, you won't lose your apartment.

Per last year 135 women asked for help from the specialists of the center with a request to provide asylum and underwent psychological counseling, 49 of them found temporary shelter for themselves and 70 children in a crisis apartment, were able to gather strength and change their lives. Julia was born in Kazakhstan, where her parents live. After graduating from school, the girl went to enter a Chelyabinsk university, got married in our city and gave birth to a child. Over time, the husband began to drink more and beat his wife. Julia hid the bruises for several months.

β€œIn the summer, I accidentally saw the telephone number of a crisis center on the Internet, wrote down their number and put it at my work. And it came in handy for me in November. I literally ran away from home - I called the center, got into a taxi and left. There are women who return to their husband again, I decided for myself that I would not return back!

Yulia has been in a crisis apartment for two months already, during this time she got a divorce, and now she needs to build a life on her own, especially since the term of stay is ending - a maximum of three months can be lived in an apartment.

As we speak, Julia constantly has tears in her eyes. Parents are far away, from relatives only the mother-in-law, who, fortunately, sided with the daughter-in-law in the conflict. Now Yulia has two tasks - to find herself a new home and arrange a child in a kindergarten. Crisis center specialists have already filed a petition with the Department of Education to expedite the receipt of a ticket.

Olga, unlike Yulia, did not get to the center herself, but was taken by the police in a terrible physical and psychological condition. She came to Chelyabinsk from the Samara region, lived with her common-law husband in a rented apartment, gave birth to a child. The husband began to beat the woman, then she called the police and tried to take the child away from her father. He flew into a rage and hit her hard in the face. Police officers took the woman with the baby to the emergency room, and then to the crisis center. It is clear that it is life-threatening for both of them to return home, and the center’s employees are now helping Olga draw up documents for receiving maternity capital to purchase housing in the future (she has another eldest son who lives with his grandmother in the Samara region).

Of the 49 women who applied to the center in 2014:
- 23 have returned to their husband or cohabitant, but are registered with the Department of Social Protection and are under constant supervision;
- 17 found support from relatives and friends;
- 9 became self-reliant and independent, found a job and bought a house.

The order of the crisis apartment

The specialists of the center are happy to help everyone who applies, but, unfortunately, this is not always possible. The most important limitation is territorial. The center was created specifically for residents of Chelyabinsk.

What do you need to get a place in a crisis apartment if you are from Chelyabinsk? An agreement is concluded with each ward for free accommodation, psychological and legal counseling for three months. For the contract, they will ask for a passport, policy, birth certificate of the child or children, a copy of the appeal to the police or a conclusion from the emergency room. Of course, leaving the house in an emergency, a woman may be left without documents. In this case, the specialists of the center contact the police, and the women they know go home to collect them and their belongings, accompanied by a policeman.

A woman receives a room for herself and her children, food and sanitary kits (various canned food, cereals, shampoos, soap, etc.). In general, residents have a fully equipped kitchen, shower, toilet, bath and washing machine. You need to maintain order on your own, like at home. Regardless of the previous status, everyone is washed, washed, and cleaned up on an equal footing. By the way, a woman with any education and any income can find herself in a difficult situation, no one is immune from such a disaster.

There are few such centers in the country. There is a small apartment in Kurgan and Yekaterinburg, but I have not yet seen such a large one as in Chelyabinsk. For example, not so long ago, a woman with a baby was in the emergency response service. Calls that save lives

Not all citizens need face-to-face counseling or temporary shelter; many more requests are received by phone. In this case, psychologists solve completely different tasks: from simple advice to getting out of a difficult psychological state.

Or here's a call. The woman says that her sister's roommate is somewhere on the street in a drunken state, she is afraid and has no idea what to do. In this case, it is very important to get out of the state of fear and calm, and then discuss possible options.

The most important thing that unites all calls is that a person is β€œobsessed” with his problem, does not see it objectively, from the outside. Our task is to show other ways out of the situation.”
